1. Object
1.1 The present contract ("Contract"), finalized as the result
of the acceptance of the subsequent article 2 by Edizioni Corpo Mente Spirito
snc of Piacenza Vittorio and Iallonardi Christian ("Edizioni CMS ")
based in Cuneo, Corso Giolitti 10, has as its object the supply of editorial
products, through paper and digital forms (the "Products" ) as indicated
on the Internet site known as "Edizioni & Centro Studi Corpo Mente
Spirito" (hereby called Edizioni CMS).
The Products will be supplied, according to the temporal duration and according
to the means laid down for each selected product on the internet site of Edizioni
CMS on the part of a physical or judicial person ("User") who, after
the accurate and truthful registration of its data (the "Data") and
payment of the relative sum as indicated in the subsequent article 3, has undertaken
to compile and telematically send to "Edizioni CMS" the order form
present on the internet site by clicking on the relative buttons located at
the bottom of the web page.
The order form will clearly indicate, at the end of the order procedure, the
actual total price of the products inclusive of delivery costs to the address
given by the User.
1.2. Edizioni CMS will undertake to deliver the Products to
the User at the address indicated by the same and Edizioni CMS has the right
to modify, at any time, and according to its unquestionable judgement, the delivery
terms and conditions by providing notification on the Edizioni CMS internet
site.
2. Effectiveness- Cancellation
2.1 The contract will be valid and effective as from the date (the "Data
of effectiveness") on which Edizioni CMS, on having verified that payment
has been made by the User of the sum of the Publication/s chosen by the same,
after correct and truthful registration of its data, should this have not already
been undertaken, and will undertake to despatch the Products. In relation to
this, Edizioni CMS and the User will mutually and specifically acknowledge that
the start of Product supply by Edizioni CMS will to all legal effects, constitute
the acceptance of the User’s proposal, proposal that, irrespective of
the precise fulfilment of the terms of the contents of the present article 2.1,
Edizioni CMS will, according to its own unquestionable judgement, have the right
not to accept orders
It remains understood that the customer on the signing of the Order form undertakes
in all cases, to collect the goods, and pay the sum due, unless it has made
use of the right of cancellation within the legally envisaged terms and means:
2.2. The User has the right, in accordance with and in relation
to the terms of Law Decree n.185/1999, to cancel the contract within 10 (ten)
working days from the date of despatch of the Order form, by sending written
notice to the head offices of Edizioni CMS, by means of registered mail with
return receipt, indicating (a) its desire to make use of the cancellation clause
(b) indication of the purchased products, (c) the date of despatch of the Order
form. The right of cancellation is, and remains excluded for order of sealed
audio-visual products opened by the User.;
In which case the User,, must undertake to return, at its own expense, all the
products in integral form and in their original packaging, to Edizioni CMS,
with insured, carriage paid postage, within 10 (ten) days of receipt of the
products themselves.
Only providing these terms have been respected, can the User obtain a refund
on the prices of eh products from Edizioni CMS. This refund will be made within
30 (thirty) days subsequent to the return of the products, and will be solely
for the price of the products as indicated on the order forms, less the carriage
and delivery costs.
3. Price and payment terms
The User will pay Edizioni CMS, as payment for the supply of the Products
and relative delivery costs, solely the sum indicated on the order form at the
time of payment. Payment will be by credit card (American Express, Mastercard,
Visa), cash on delivery, bank transfer or postal order.
The above being understood, , Edizioni CMS reserves the right to at any time
modify the prices of the products indicated on the internet site of Edizioni
CMS.
4. Payment default – Suspension and termination of the supply
The User acknowledges the fact that in the event of any default or unsuccessful
payments, found as the result of checks made by the payment system in use, Edizioni
CMS will reserve the right to either suspend and/or interrupt and/or definitively
terminate the Product supply. It remains understood that Edizioni CMS has the
right to enact procedures and human resources, both within and outside the company,
for the purposes of credit recovery and to also claim the related costs of the
editorial products in the catalogue.
5. Communications
Any communication relative to the present Contract must be made by the User
by e-mail and will be considered as being valid and effective on receipt of
the same at the following address of Edizioni CMS: "orders@massage-learning.com"

6. Applicable law and controversies
6.1. The present Agreement is regulated by the Italian law. The eventual
cancellation and/or invalidity of the same, either totally or partially, of
one or more articles of the same, will not affect the other articles container
in the present Contract, which must be considered as being completely valid
and effective.
6.2. With the exception of the terms of 'article 1469bis, third
paragraph, n. 19 of the Civil code, in the event of any controversy that may
arise in relation to the present Contract, including any controversies relating
to the interpretation, stipulation, implementation, its judicial existence or
non-existence, validity and non-validity, cancellation and recession, the law
court of Cuneo will have sole jurisdiction.
Approval in accordance with the terms of articles 1341 and
1342 Civil Code
In accordance with the terms of Articles 1341 and 1342 of the
Civil Code, I declare that I have carefully read and examined all the clauses
and conditions container in the present Contract, and that I specifically accept
and approve the following articles: 1, 2, 3, 4, 5, 6.
